Connecticut Foreclosure Mediation Program

If you have been served with a foreclosure complaint, you are in danger of losing your home. However, Connecticut’s new Foreclosure Mediation Program has been set up to assist certain homeowners/borrowers whose home is the subject of a mortgage foreclosure action.

You are eligible of the Foreclosure Mediation Program if:

  • You are the owner-occupant of a one-to-four family residential property;
  • You are the borrower;
  • The mortgage on your owner-occupied residential property is being foreclosed;
  • The property being foreclosed is your primary residence;
  • The property is located in Connecticut; and
  • The foreclosure action has a return date on or after July 1, 2008.

Mediation is a process by which a neutral third party (mediator) assists the homeowner and lender in reaching a fair, voluntary, negotiated agreement.  The mediator does not decide who is right or wrong.

Mediators:

  • Are employed by the Judicial Branch of the State of Connecticut;
  • Are trained in mediation and all relevant aspects of the law;
  • Have knowledge of the community-based resources that are available in the judicial district in which they serve; and
  • Have knowledge of the mortgage assistance programs.

The program addresses all issues of foreclosure, including, but not limited to, reinstatement of the mortgage, assignment of law days, assignment of sale date, restructuring of the mortgage debt and foreclosure by decree of sale.

To participate in the Foreclosure Mediation Program, you must complete the attached
Foreclosure Mediation Request form, JD-CV-93, and file it with the court. You must also fill out and file an Appearance form, JD-CL-12, which you may get at any Judicial District courthouse or from the Judicial Branch website at www.jud.ct.gov.

There is no application fee for this program.
